However, this is a common oversight, especially in today’s litigious world, where appeals are often pursued and legal disputes may continue for quite some time. With that being said, an appeal’s success substantially depends on counsel’s ability to evaluate the factors and risks that are involved, which include identifying the arguments either underpinning or undermining a successful appeal, and fully understanding the trial and appellate processes to persuade appellate judges to rule in the client’s favor.
At Scarinci Hollenbeck, our veteran appellate practitioners, some who were law clerks to Appellate Judges and N.J. Supreme Court Justices, have gained an intimate knowledge of the appellate process that trial lawyers, who may only occasionally be involved in an appeal, do not possess. Our attorneys have won on appeal precedent setting matters. Our appellate attorneys also have the advantage of corresponding with colleagues in virtually every area of law, providing them with the breadth of knowledge necessary to assess any appeal appropriately. As a result, we have significant advantages in advising clients whether an appeal is warranted and what its chances of success may be.
