Lawsuit to Overturn Zoning Ordinance at The Heights at Monmouth Dismissed

Scarinci Hollenbeck successfully secured a judgment on behalf of a developer seeking to redevelop the Monmouth Mall, turning back a challenge to a zoning ordinance that allows mixed-use buildings at the mall. The suit was filed by a group of Eatontown residents opposed to the redevelopment project, otherwise known as The Heights at Monmouth. The group accused the Borough of Eatontown of violating the Municipal Land Use Law and the Open Public Meetings Act. Scarinci Hollenbeck successfully intervened on behalf of the developer and in favor of the Borough. After a bench trial, the court found in favor of the Borough.

New Jersey ATCs Can Now Post Medical Marijuana Prices

As the medical marijuana industry in New Jersey expands and becomes more competitive, dispensaries will be able to post their prices. The New Jersey Department of Health recently announced that the state’s six existing Alternative Treatment Centers (ATCs) can now publicly list medical marijuana prices on their websites and social media accounts.

Can We Talk? Guidance on NYC’s New Cooperative Dialogue Requirements

Earlier this year, the City of New York amended the New York City Human Rights Law (NYCHRL) to require employers to engage in a cooperative dialogue with individuals who may be entitled to a reasonable accommodation under the statute. The new requirements take effect on October 15, 2018. In advance of the effective date of the new law, New York City Commission on Human Rights (Commission) recently issued guidance regarding employer compliance, particularly with respect to disability discrimination.

Is It Time to Restrict Your CEO’s Twitter Account?

Tesla founder and CEO Elon Musk recently drew the ire of the Securities and Exchange Commission (SEC) when he tweeted to his 22.3 million followers on Twitter that he was planning to take his company private. On August 7, 2018, Musk tweeted: “Am considering taking Tesla private at $420. Funding secured.” Following this tweet, Tesla’s stock price jumped by over six percent, a significant impact on the market that many attributed to the tweet. The impact was keenly felt by short-sellers, with whom Musk had been feuding.  Tesla later confirmed that a final decision about taking the company private had not yet been reached.
