U.S. Attorney’s Office Alumni Association for NJ Selects New Trustee

Scarinci Hollenbeck is pleased to announce that retired Superior Court Judge, Ronald Lee Reisner, J.S.C. (Ret.), has been selected to be on the Board of Trustees of the U.S. Attorney’s Office Alumni Association for the District of New Jersey. Judge Reisner, who joined the firm  after serving fifteen years as a Superior Court Judge in Monmouth County, is also a Trustee for HABcore, Inc. HABcore is a charitable organization which provides permanent and supportive housing for homeless veterans, families and individuals with special needs.

New Jersey Environmental Attorneys Successful in Office of Administrative Law

Scarinci Hollenbeck is pleased to announce that John M. Scagnelli and William A. Baker of the firm’s Environmental Land & Use Law Group achieved a successful result on behalf of R&K Associates, LLC a case tried in the Office of Administrative Law (“OAL”) and upheld in a Final Decision by Katherine R. McCabe, Commissioner of NJDEP.  The case is captioned R&K Associates, LLC v. New Jersey Department of Environmental Protection and Des Champs Laboratories, Inc., OAL Dkt. No. ESR-13443-17.  To date, there have been three Appellate Division decisions, an OAL trial and an OAL hearing.

Will Proposed Regulations in REG-106706-18 Adversely Impact Estate and Gift Tax Exemptions?

In REG-106706-18, the IRS has issued proposed regulations that provide that individuals taking advantage of the increased gift and estate tax exclusion amounts in effect from 2018 to 2025, as provided for by the Tax Cuts and Jobs Act (TCJA), will not be adversely impacted after 2025 when the exclusion amount is scheduled to drop to pre-2018 levels.

Lawsuit to Overturn Zoning Ordinance at The Heights at Monmouth Dismissed

Scarinci Hollenbeck successfully secured a judgment on behalf of a developer seeking to redevelop the Monmouth Mall, turning back a challenge to a zoning ordinance that allows mixed-use buildings at the mall. The suit was filed by a group of Eatontown residents opposed to the redevelopment project, otherwise known as The Heights at Monmouth. The group accused the Borough of Eatontown of violating the Municipal Land Use Law and the Open Public Meetings Act. Scarinci Hollenbeck successfully intervened on behalf of the developer and in favor of the Borough. After a bench trial, the court found in favor of the Borough.

ABA Names NJSBA Environmental Forum as 2017 Program of the Year

Scarinci Hollenbeck is pleased to announce that the American Bar Association (ABA) Section of Environment, Energy and Resources has selected the 2017 NJSBA Environmental Law Forum as Program of the Year. The Forum is an annual event hosted by the NJSBA Environmental Law Section. Daniel T. McKillop, Counsel in the firm’s Environmental & Land Use Law group, currently serves as Vice-Chair of the NJSBA Environmental Law Section and as one of the Forum chairpersons.

Roshan D. Shah Successful in $35M+ Bid Protest for Defense Contract Firm

Scarinci Hollenbeck successfully represented AASKI Technology, Inc. ("AASKI") in a bid protest before the Government Accountability Office (GAO), preserving the company’s award to provide technical support services to the U.S. Army. BANC3, Inc., the current incumbent, protested the award, challenging the agency’s evaluation of proposals. On September 10, 2018, the GAO rejected BANC3’s protest and upheld the award to AASKI, clearing the way for the Tinton Falls contractor to begin work on a $35+ million Department of Defense contract.
