201-896-4100 info@sh-law.comCharles Yuen, a Partner and member of the Scarinci Hollenbeck’s Litigation Practice Group has been named Co-Executive Editor of the American Bar Association’s Tort Trial and Insurance Law Journal (ABA TIPS Journal) for the 2016-17 publishing year. The light blue periodical features high quality law review articles from top lawyers in the country, presenting issues of critical importance and is a bookshelf fixture for the 30,000 lawyer members of one of the ABA’s largest sections.
Mr. Yuen’s managerial position involves working with the Journal’s editorial board, the article authors, the ABA TIPS Journal section committee leadership, and the employees of the ABA. He has served on the editorial board since 2008. TIPS is the go-to source of knowledge of leadership on trial practice and critical issues of justice that involve tort and insurance law. The section is unique within the ABA and the legal community because of its focus on balance and diversity, as it brings together plaintiffs, defense, corporate and in-house counsel to discuss and examine issues confronting the practice of tort and insurance law.
At Scarinci Hollenbeck, Mr. Yuen is Chair of the firm’s policyholder-oriented Insurance Recovery and Liability Group. He has extensive experience in contract law and related disputes. He has worked on complex multijurisdictional corporate, commercial, construction, insurance and reinsurance coverage lawsuits as well as major cases involving alleged breaches of joint venture, executive employment, and franchise agreements. Mr. Yuen’s work has also involved RICO, qui tam, hospital, privacy, ERISA, trademark, patent, environmental, professional, securities, commercial, regulatory, insolvency, and bankruptcy law and issues of damages and equitable relief, including temporary restraints and preliminary and permanent injunctions. He has also defended corporations against product liability suits, including asbestos-related “mass tort” and property damage allegations. He is familiar with and has analyzed all major types of insurance policies, including for example general and automobile liability; product liability; environmental liability; property; errors and omissions; directors and officers; maritime; fiduciary; employment; hospital; Bermuda form; title; fidelity; surety; umbrella; and excess.
Mr. Yuen regularly publishes articles and speaks on insurance-related topics. A 1990 Columbia University Business Law Review article Mr. Yuen co-authored analyzed the history of key standard form wording in general liability policies. The article has been cited and discussed by four U.S. state supreme courts (California, Wisconsin, Maryland, and Iowa). Three of those courts unanimously adopted the position Mr. Yuen advocated. The article has been, and continues to be, regularly cited and submitted by litigants to appellate courts across the U.S.
