New Jersey has taken another significant step toward expanding nuclear generation as Governor Mikie Sherrill convened the first meeting of the State’s Nuclear Task Force on October 1, 2026, and launched the new “Nuclear NJ” public information website. Together, these initiatives signal that New Jersey is moving from broad policy discussions to the practical regulatory, financing, workforce, and public-engagement efforts needed to support the deployment of next-generation nuclear technologies.

The Task Force meeting follows a series of actions undertaken by the Sherrill Administration in 2026 to position nuclear energy as a central component of the State’s long-term energy strategy. According to the Governor’s Office, nuclear power currently supplies more than 40 percent of New Jersey’s electricity and approximately 80 percent of its carbon-free generation. State officials have emphasized that additional generation capacity may be necessary to address increasing electricity demand, improve grid reliability, support economic growth, and moderate long-term energy costs.

Nuclear Task Force: From Policy Goal to Implementation Framework

The newly convened Nuclear Task Force reviewed a draft charter and established five subcommittees focused on the areas widely recognized as critical to successful nuclear deployment: regulatory and permitting frameworks, financing and deal structures, supply-chain and technology development, workforce growth and training, and public trust and confidence. These workstreams suggest that New Jersey is beginning to address the practical barriers that have historically slowed large-scale energy infrastructure development.

The Task Force was created under Executive Order No. 2, issued at the outset of the Sherrill Administration. The order directed state agencies to address electric reliability concerns, accelerate energy infrastructure development, and prepare for increasing demand on the regional PJM grid, including demand associated with data centers and advanced technologies.

Recent Legislative Changes and the Nuclear Task Force

The Task Force’s work is occurring against the backdrop of two major legislative developments.

First, New Jersey amended provisions of the Coastal Area Facility Review Act, N.J.S.A. 13:19-1 et seq., removing a long-standing restriction that had effectively prevented construction of new nuclear facilities unless a federally approved permanent radioactive-waste disposal method existed. Under the revised framework, permit decisions may proceed where waste-management approaches satisfy applicable Nuclear Regulatory Commission (“NRC”) requirements.

Second, the State enacted the Power NJ Act, which establishes a competitive procurement process for at least 1,100 megawatts of new nuclear generation. The legislation directs the New Jersey Board of Public Utilities (“NJBPU”), working with the New Jersey Economic Development Authority (“NJEDA”), to evaluate projects based on affordability, reliability, public-interest considerations, financing arrangements, consumer protections, and public-safety requirements. State officials have emphasized that projects must secure federal financing, demonstrate a net benefit to ratepayers, and undergo public-comment and hearing processes before final approval. The Administration has also said ratepayers will not be expected to fund construction before operation and that protections are intended to limit exposure to construction cost overruns.

Focus on Advanced Nuclear Technologies

While no specific project has yet been selected, much of the public discussion surrounding New Jersey’s nuclear strategy has focused on advanced reactors and small modular reactor (“SMR”) technology. These technologies are receiving increasing attention nationally because they are designed to provide carbon-free baseload electricity with potentially lower capital requirements and greater siting flexibility than traditional nuclear facilities.

The federal government has similarly increased its support for advanced nuclear deployment through programs administered by the U.S. Department of Energy, federal loan programs, and licensing initiatives overseen by the NRC. New Jersey’s emphasis on financing structures, supply chains, and regulatory coordination mirrors many of the issues being addressed at the federal level as states explore next-generation reactor deployment.

Public Engagement and Regulatory Transparency

An important component of the State’s strategy is the launch of the Nuclear NJ website. Developed jointly by the NJBPU, the New Jersey Department of Environmental Protection (“NJDEP”), and the NJEDA, the website is intended to serve as a centralized repository of information regarding affordability, reliability, safety, waste management, emergency preparedness, workforce development, and project updates. State officials have stressed that any future nuclear project would remain subject to extensive federal and state oversight, including NRC licensing requirements, environmental permitting, emergency-planning obligations, and opportunities for public participation.

Conclusion

The State’s recent actions do not authorize immediate construction of new nuclear facilities. However, they demonstrate that New Jersey is actively creating the regulatory and policy framework necessary to support future nuclear development. For energy developers, infrastructure investors, major electricity users, data-center operators, labor organizations, and technology companies, New Jersey’s actions suggest that advanced nuclear energy will remain a significant component of the State’s economic-development and energy-reliability agenda for years to come. Operators and other organizations affected by these developments should closely monitor the Nuclear Task Force’s recommendations and subcommittee reports, NJBPU’s implementation of the Power NJ Act, potential procurement opportunities for new generation projects, and evolving federal NRC licensing and financing programs.
