Little Falls, NJ – September 28, 2023 – David Edelberg, Partner and Chair of Scarinci Hollenbeck’s Bankruptcy and Creditors’ Rights Practice Group, successfully resolved an objection to client Gregory DePaolo’s bankruptcy discharge in the Bankruptcy Court for the District of New Jersey. Through Scarinci Hollenbeck’s vigorous representation, Mr. DePaolo resolved the $480,000 objection in exchange for a $35,000 judgment.
“We are pleased to have successfully resolved this matter for our client,” said Mr. Edelberg. “The resolution highlights that having a strong litigation position often leads to a favorable outcome.”
Plaintiffs Daniel Albizati and Howard Bleznick objected to the discharge of their $480,000.00 claim against Mr. DePaolo. Mr. DePaolo successfully settled the discharge objection by agreeing that only $35,000.00 would not be discharged. Thus, Scarinci Hollenbeck settled the claim for approximately seven percent of the plaintiffs’ initial demand amount.
The settlement also included favorable payment terms which allow Mr. DePaolo to make monthly payments for up to a seven year period.
The case is Bleznick et al v. DePaolo (2:22-ap-01158), New Jersey Bankruptcy Court.
