Red Bank, New Jersey, April 20, 2018 – Scarinci Hollenbeck secured the dismissal of a $10 million dollar lawsuit brought against their clients, the City of Asbury Park and its police officers. The lawsuit arises from an event that rocked Monmouth County and resulted in criminal charges against former Neptune police officer Phillip Seidle. On June 16, 2015, Seidle fatally shot his ex-wife near Sewall Avenue in Asbury Park. The Estate of Tamara Seidle and her children filed suit against 26 different public entities and employees claiming that law enforcement personnel on the scene failed to take appropriate action to stop Seidle, and also blamed the Neptune Police Department and Monmouth County Prosecutor’s Office for permitting Seidle to have access to a firearm.

According to the Asbury Park Press, the lawsuit claimed wrongdoing on the part of Asbury Park police officers, arguing that they “failed to take Philip Seidle down by the use of lethal force.” Roshan D. Shah, the attorney for Asbury Park and its employees, argued that a rule requiring officers to use deadly force when faced with a given set of circumstances was contrary to the law, irresponsible and dangerous.
After a contentious three-hour argument in federal court yesterday, the Hon. Michael A. Shipp, U.S.D.J., dismissed the lawsuit without prejudice. Plaintiffs will have one more opportunity to amend their complaint and allege viable claims.
“We are pleased with the court’s decision. We look forward to round two,” stated Roshan.
