Could Your Super Bowl Party Land You In Hot Water?

Even though New York will not be represented in this year’s Super Bowl, many local sports fans will be “out and about” to watch the game as guests of Super Bowl parties. While we do not wish to spoil the fun, party hosts should be aware that there is potential legal liability related to Super Bowl parties, particularly when alcohol is served.
One of the greatest risks is that a guest or third party is injured in an accident related to alcohol consumed at your party. As a first step, it is recommendable to review your homeowner’s policy or comprehensive general liability policy with your insurance professional to make sure that you are covered for such possible claims.
To avoid being sued, businesses and individuals should plan to take appropriate actions to deter guests from drinking excessively and driving. Here are a few suggestions:
- For businesses, host the event at a licensed establishment that has liability insurance to cover the event.
- For individuals, consider hiring a licensed caterer or bartender and make sure that they carry liability insurance and are trained to limit excessive alcohol consumption.
- Make food and non-alcoholic beverages widely available so that guests have alternative choices.
- Do not serve alcohol to guests who are visibly intoxicated.
- Arrange safe transportation or overnight accommodations for guests who have had too much to drink.
The Super Bowl is one of the most exciting sports events of the year. While we certainly don’t want to put a damper on your celebration, we do urge individuals and businesses to exercise caution and manage the risks.
