Lyndhurst, N.J. – December 16, 2015Fernando M. Pinguelo is recognized as a “Cybersecurity & Data Privacy Trailblazer” by The National Law Journal for 2015. Pinguelo, a partner and Chair of Scarinci Hollenbeck’s Cyber Security & Data Protection and Crisis & Risk Management groups, leads a team of attorneys and technical professionals dedicated to data breach response and litigation, compliance, and E-Discovery.

The Cybersecurity & Data Privacy Trailblazers award recognizes legal professionals who “have moved the needle” and exemplified innovation in addressing novel data privacy and security legal issues posed by changing technologies. It is awarded to only 50 attorneys from the United States and abroad. Fernando M. Pinguelo is the only recipient from a New Jersey based law firm to receive the Trailblazer Award.

“We are thrilled that our firm achieved this recognition for our work in the cybersecurity and data privacy field,” said Scarinci Hollenbeck managing partner Ken Hollenbeck. “Fernando has worked hard to put us on the map and he and his team have helped us earn our reputation as one of the best in the field.”

Pinguelo, accredited as a Certified Information Privacy Professional by the International Association of Privacy Professionals, has been at the forefront of developments in the law triggered by rapidly evolving technologies since 2006 when, in the middle of a four-week trial, a witness unexpectedly revealed that certain data had “resurfaced.”

With the help and experience of Fernando M. Pinguelo, Scarinci Hollenbeck is building a dextere and highly respected privacy and data security practice in this region.

“Dealing with a crisis like that required both a working knowledge of technology and creativity in applying longstanding legal and procedural principles to such a novel set of circumstances – in fact, the first of its kind in New Jersey at the time,” explained Pinguelo. “At that moment I recognized just how much of an impact electronic data can have on litigation, and began to appreciate how cyber security, data protection, and E-Discovery would emerge to become an integral part of legal and business landscapes.”

Since then, Pinguelo’s law practice has grown in size and technology sophistication with clients most often turning to him in crisis situations where options are few and the risks high.  His numerous published articles and speaking engagements in his areas of practice reflect the depth of his knowledge and understanding of the issues that his clients face. Pinguelo also designed one of the first state-of-the-art electronic discovery law courses in the country, which he teaches at Seton Hall University School of Law.

Pinguelo’s practice includes international matters with a particular emphasis on Brazil. Fluent in Portuguese, he serves as U.S. national coordinating counsel for one of Brazil’s premier cyber law firms, Opice Blum, Bruno, Abrusio e Vainzof Advogados Associados. He has also served as a visiting professor at Universidade Presbiteriana Mackenzie as part of his Fulbright Specialist appointment.

Pinguelo and his team regularly handle “crisis litigation,” including emergency applications before the courts, and represent individuals, businesses, and government agencies in developing and implementing data breach response and compliance programs related to the laws and standards that regulate the collection, use, sharing, storage and protection of personal and business data.
