Scott E. Koop serves as Counsel in the New York office of Scarinci Hollenbeck, LLC. He brings over a decade of experience advising clients on a range of real estate matters and representing them in related litigation. Prior to joining the firm, Mr. Koop practiced at a boutique Midtown Manhattan law firm, where he developed a hybrid practice representing individuals, developers, investors, lenders, landlords, tenants, and business owners across both transactional and litigation matters.
Business and Real Estate Litigation
Mr. Koop represents clients in complex commercial and real estate-related disputes, including construction defect claims, commercial lease enforcement, partition actions, foreclosures, business torts, and intellectual property matters. He has successfully litigated cases in both New York and New Jersey, and has represented clients at trial, on appeal, and before arbitration panels and administrative bodies. His litigation approach is shaped by a deep understanding of the transactions that often underlie these disputes.
Real Estate and Financing Transactions
On the transactional side, Mr. Koop advises clients on residential and commercial real estate purchases and sales, leasing, financing, and development. His work includes drafting and filing offering plans for condominiums and co-ops, preparing governing documents, and negotiating commercial leases and financing agreements. He represents both private and institutional clients in deals involving multi-family and mixed-use properties throughout New York and New Jersey.
Mr. Koop’s experience handling matters from both legal and practical angles enables him to anticipate risk, resolve conflicts efficiently, and serve as a versatile resource for clients with intertwined legal needs.
Commercial and Real Estate Litigation
- Represented the purchaser of a new-construction condominium unit in a lawsuit against the condominium sponsor and the sponsor’s principals asserting major construction defects, resulting in a very favorable settlement on the eve of a jury trial
- Represented an institutional lender in foreclosing on and selling a multi-million dollar commercial property in upper Manhattan
- Represented an online retailer asserting breach of contract claims against a major web-hosting service provider, resulting in a positive outcome at arbitration
- Represented the tenant-in-common in an action involving partition and sale of jointly owned real property, resulting in a favorable judgment issued on a dispositive motion
- Represented an individual in proceedings under the real property laws involving a license agreement for a neighboring condominium developer’s construction work, resulting in a favorable court order imposing licensing terms, requiring the developer to provide insurance, and ordering payment of a monthly license fee during the period of construction
Transactional Matters
- Represented the sponsor of a new condominium development in Greenpoint, Brooklyn, in drafting and filing the Offering Plan and Declaration with the Attorney General’s Office; then also represented the sponsor for selling new units
- Represented several clients from contract negotiation to closing for their purchases of multi-million-dollar units in a newly-developed Manhattan condominium building
- Represented a closely-held corporation in the purchase of multi-family residential and commercial buildings in Jersey City, New Jersey
- Represented the purchaser of numerous commercial properties in downtown Brooklyn, from contract negotiation through closing
