William R. Samuels, Scarinci Hollenbeck Partner and Chair of the firm’s Copyright and Trademark practice group and Joel R. Glucksman, Partner and Chair of the firm’s Bankruptcy & Creditors’ Rights Law Group will participate in a panel discussion at the New York State Bar Association’s (NYSBA’s) Intellectual Property (“IP”) Section Fall Meeting. The theme of the meeting will be “Around the Edges of IP,” exploring issues that arise in Intellectual Property across a variety of legal disciplines. Samuels will moderate, and Glucksman will be a panelist on “Complexities of IP in Bankruptcy.” The panel will discuss IP license agreements in the context of bankruptcy, including enforceability and the challenges that arise relating to the assumption, assignment, or rejection. Panelists will also provide an overview of the Bankruptcy Code sections applicable to IP, discuss how different forms of IP are treated differently in bankruptcy, and address best practices for drafting license agreements from the perspective of both a licenser and licensee.
